Many citizens are unaware of the resources available to them or their Constitutional Rights in the State of Illinois. As a private citizen that has been through the court process, I saw the Divide between the courts and court officers and the citizens that attempt to seek justice in them firsthand. There were many individuals who cared and did their best to assist me and there will always be those individuals that do not believe citizens should be "Pro Se" or should be involved in the courts if not represented by an attorney. I have experienced the bias and prejudice against "Pro Se" firsthand.
I do understand both sides of that. Many are "Pro Se" because an attorney will not make arguments or approach certain aspects of the harm that was caused out of inconvenience. For some who want their day in court many attorneys will only take a case if they believe they are able to settle relatively fast and will not take case knowing there will be no choice but to go to trial especially if they are covering the costs of litigation until resolution.
From the court perspective many are trying to take advantage of the courts for a quick payday or cover up the harm an individual chooses to cause to another. Many citizens misinterpret the law and use caselaw and other laws improperly for the harm they caused. The information shared on this website are direct examples from my court cases and experiences.
The things discussed and shared on this website do not apply for court cases if you are the individual causing harm to others. Part of the Illinois State Constitution is the Bill of Rights and a single section that reminds the citizens of their duties and responsibilities for those rights. It states as follows:
SECTION 23. FUNDAMENTAL PRINCIPLES
A frequent recurrence to the fundamental principles of
civil government is necessary to preserve the blessings of
liberty. These blessings cannot endure unless the people
recognize their corresponding individual obligations and
responsibilities.
(Source: Illinois Constitution.)
To simplify this section, all individuals have all the Constitutional Rights guaranteed by the Illinois Constitution as well as those guaranteed by the United States Constitution. I will address these extra rights in Illinois Constitution Section. For these rights every individual has a duty to others' rights. This means when an individual causes harm to another or violate any of their rights, we can be held accountable by the state on behalf of another individual for say theft / deprivation of property or murder / deprivation of life. Another misconception is the process. All have a right to face their accusers. This applies to a jury. If there is no jury present, you are not actually in trial. Many steps have to happen before you get to that point. If the state is charging an individual, there is a victim, and you will have the right to face that accuser in trial.
These steps are referred to as DUE PROCESS. Due Process are the steps taken so all parties know what is being presented to a jury, and all parties have the evidence to be presented to a jury, so all parties may validate or discredit information. There will be many steps along the way. On this website we will go over the DUE PROCESS of the courts, so all know what to expect.
This website will present an Appeal and Federal Lawsuit that resulted from actions throughout the original complaint. These examples are to show that regardless of how much or how many are working against you, you can find justice for harm done upon you or your family and resources to protect your rights.
I hope my experience can help assist others that may face similar experiences. The facts in my cases are unique and apply to my specific situation. The case laws provided first and through September 2024 will be case law that was used in my complaint, motions, and arguments. Bad Faith is more common than the specific circumstances of my complaint. So is elder and minor exploitation. How it applies to mine are due to specific facts of my complaint. Constitutional Rights and Duties apply to every resident of this State at all times. During my research I found many unique laws and caselaw that addressed a broad range of issues, and I will be sharing those after all other information has been provided.
If you have had any experiences like the example cases provided, and you would like to share your experiences and how you addressed the issues please contact us: information@justiceinilcourts.com
